By accessing or using Kynkz (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
Kynkz is a search and aggregation platform that indexes metadata and may display embedded players from third-party content providers (“Providers”). Kynkz does not upload, host, or store the underlying videos. All video files and streams are hosted by their respective Providers, and are subject to those Providers’ terms and policies.
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that viewing adult content is lawful in your location. We encourage the use of device-level parental controls to prevent access by minors.
All video content is provided by third-party Providers. Copyright for such content is held by the respective owners. Kynkz displays indexes, thumbnails, metadata, and/or embedded players as permitted by Provider tools and terms.
If a Provider removes or restricts a video, our listings typically reflect that change automatically. We aim to mirror Provider removals across our site within 48 hours.
Because we do not host the videos, the most effective way to remove infringing content is to submit a DMCA notice directly to the hosting Provider. Once a Provider disables or removes a video, Kynkz will stop indexing or embedding it and will reflect the change, typically within 48 hours. For search-result or thumbnail removal requests on Kynkz, please include the Provider URL demonstrating the takedown and contact us via [email protected] or visit /takedown.
For content hosted by Providers, the required 18 U.S.C. §2257 records are maintained by those Providers or the original producers. See our dedicated statement at /2257.
Your use of the Service is also governed by our Privacy Policy. We may use third-party analytics and advertising partners as described there.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT CONTROL OR GUARANTEE THE AVAILABILITY, ACCURACY, OR LEGALITY OF THIRD-PARTY CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kynkz AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
You agree to defend, indemnify, and hold harmless Kynkz from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or applicable laws.
We may suspend or terminate access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.
These Terms are governed by the laws of the jurisdiction of our incorporation, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of the courts located in that jurisdiction for any dispute not subject to alternative dispute resolution.
We may update these Terms from time to time. Changes are effective upon posting on this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
